At Eight to Eighty Eyewear (“we,” “us,” or “our”), we value your privacy and are committed to protecting your personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website www.eighttoeighty.com (the “Website”) or make a purchase from us. By using our Website, you agree to the terms of this Privacy Policy.
1. Information We Collect
We may collect the following types of information:
a. Personal Information
- Contact Information: Name, email address, phone number, and shipping/billing address provided when you place an order, create an account, or contact us.
- Payment Information: Card and ACH payments are made on the secure pages of our payment processors, PayTrace and Stripe. We do not receive or store full card or bank account numbers; the processor tells us about the payment, such as the amount, who paid, and whether it cleared.
- Account Information: Your name, email address, company details, password (stored only in scrambled, hashed form), order history, and saved lists, if you have an account on our Website. While you are signed in, we also keep your cart (with its notes) and your website settings, such as language and night mode, so they follow you to your other devices. A cart left untouched for 30 days is emptied.
- Orders and Requests: The orders you send through our Website (frames, quantities, notes, PO numbers, and shipping details) and the messages and requests you send through our contact, request, and feedback forms, including the page you were on when you sent feedback.
- Order Notes: A note you add to an order line prints on the receipt we email to you and to our order desk and is kept with the order, so please use a tray number or a patient’s name there, not health details.
- Chats with Otis: What you write to Otis, our chat assistant, and his answers, with the page you were on, the language you read the site in and your type of device. If you are signed in, we keep your account details with the chat; they are not sent with your messages. The chat is also linked to the random visitor number described below. If you ask him to pass a message to our office, the name, contact details and message you give him.
b. Other Information
- Visit Data: When you open a page, it sends us the page’s name and a random visitor number kept in your browser, so we can count visitors and see which pages are used. We keep only a scrambled (hashed) form of that number, never your IP address or browser details, and delete visit records after 400 days.
- Security Data: Your IP address and browser type, recorded with each sign-in, with your account’s security activity, and with each order you send, and your IP address with each request, message, or feedback you send through our forms. We use them to protect your account and our Website and to limit how often our forms can be sent.
- Notification Data: If you turn on notifications, the address your browser’s push service gives us, with your device type (phone, tablet, or computer) and language.
- Marketing Preferences: Your preferences for receiving promotional emails or newsletters.
2. How We Collect Information
We collect information in the following ways:
- Directly from You: When you place an order, request an account, catalog, samples, or tracking, contact customer support, send feedback, or join our mailing list.
- Automatically: Through the cookies and browser storage described in our Cookies Policy and the visit records described above. We do not use Google Analytics or any other third-party analytics or advertising tools.
- From Third Parties: From service providers, such as payment processors or shipping companies, to fulfill your orders or provide customer support.
3. How We Use Your Information
We use your information to:
- Process and fulfill your eyewear orders, including shipping and returns.
- Communicate with you about your orders, account, or customer service inquiries.
- Send the browser notifications you have turned on.
- Send promotional emails, newsletters, or offers (with your consent, where required).
- Improve our Website, products, and services through analytics and user feedback.
- Prevent fraud and ensure the security of our Website.
- Comply with legal obligations or resolve disputes.
4. How We Share Your Information
We do not sell your personal information. We may share your information with:
- Service Providers: Third parties that help us operate our business: our payment processors (PayTrace and Stripe), shipping carriers (UPS, FedEx, and USPS), and our website hosting and email providers. These providers are contractually obligated to protect your information.
- Website Features: Some features send information straight from your browser to an outside service. What you type in a street-address field goes to Photon (an OpenStreetMap address search run by komoot) to suggest addresses; our typefaces load from Google Fonts; Scan Order’s camera may load its barcode reader from jsDelivr; and notifications you turn on are delivered through your browser’s push service (Apple, Google, Microsoft, or Mozilla). These services receive your IP address and browser details with each request. See our Cookies Policy for more detail.
- Our Chat Assistant: What you write to Otis, our chat assistant, is sent to Anthropic, whose Claude AI writes his answers, with the date and time, the page you are on, the language you read the site in and whether you are signed in. Please don’t type card or bank numbers, passwords, or a patient’s health information into the chat.
- Text Messages and Calls: Our texts are delivered, and calls to our number are connected, by Twilio, which receives your phone number and what is sent or said. See section 13.
- Legal Compliance: If required by law, regulation, or legal process (e.g., court order or subpoena), or to protect the rights, property, or safety of Eight to Eighty Eyewear, our customers, or others.
- Business Transfers: In the event of a merger, acquisition, or sale of all or part of our business, your information may be transferred to the acquiring entity.
5. Cookies and Tracking Technologies
We use a small number of cookies and similar technologies to keep the Website working and to remember your choices. We do not use them for advertising or third-party analytics. Types of cookies we use include:
- Essential Cookies: Necessary for the Website to function properly (e.g., keeping you signed in and keeping your cart).
- Preference Cookies: Remember choices you make, such as language and night mode.
- Visit Counting: A random number kept in your browser lets us count visitors without identifying them.
You can block or delete cookies in your browser settings, but signing in and other parts of the Website may not work without them. See our Cookies Policy for the full list.
6. Your Choices and Rights
Depending on your jurisdiction, you may have the following rights regarding your personal information:
- Access: Request a copy of the personal information we hold about you.
- Correction: Request correction of inaccurate or incomplete information.
- Deletion: Request deletion of your personal information, subject to legal obligations.
- Opt-Out: Opt out of marketing communications by clicking “unsubscribe” in our emails or contacting us.
- Restrict or Object: Restrict or object to certain uses of your information (e.g., for direct marketing).
To exercise these rights, please contact us at customerservice@eighttoeightyeyewear.com. We may verify your identity before processing your request.
If you are a California resident, see our CCPA Notice for your rights under California law and how to make a request.
7. Data Security
We implement reasonable technical and organizational measures to protect your personal information from unauthorized access, loss, or misuse. However, no system is completely secure, and we cannot guarantee absolute security.
8. Data Retention
We retain your personal information only as long as necessary to fulfill the purposes outlined in this Privacy Policy, comply with legal obligations, or resolve disputes. For example:
- Order information is retained for 10 years to process returns or warranty claims.
- Account information is retained until you request deletion or your account becomes inactive for 10 years.
- Visit records are deleted after 400 days.
- Brochures made with Build Brochure are deleted from our server after 30 days.
- Chats with Otis, our chat assistant, are deleted a year after their last message.
- Your mobile number for texted sign-in codes is deleted when you turn them off, and our record of each text we send after 180 days.
9. International Data Transfers
If you are located outside the United States, your information may be transferred to and processed in the United States or other countries where our service providers operate. We ensure appropriate safeguards are in place, such as Standard Contractual Clauses, to protect your data.
Some of the services named in section 4 also operate outside the United States; for example, the Photon address search is run by komoot, a company based in Germany.
10. Children’s Privacy
Our Website is not intended for individuals under 16 years of age. We do not knowingly collect personal information from children under 16. If we learn that we have collected such information, we will delete it promptly.
11. Third-Party Links
Our Website contains links to third-party websites, such as our payment processors (PayTrace and Stripe), Calendly for booking a video call, carriers’ tracking pages, and our social media pages. We are not responsible for the privacy practices or content of these websites. Please review their privacy policies before providing personal information.
12. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. We will notify you of significant changes by posting the updated policy on our Website with a revised “Last Updated” date. Your continued use of the Website after such changes constitutes your acceptance of the updated policy.
13. Text Messages and Phone Calls
Sign-in codes: If you choose to receive sign-in codes for our customer portal by text message, we collect your mobile number, a record of each text we send you (when, and whether it went), and a record of your agreement to receive them (the date and time, your IP address, and the wording you agreed to). We use your mobile number only to send these codes. We don’t send marketing texts. Our Text Messages page explains how they work and how to stop them.
Calling or texting us: If you call or text our number, Otis, our AI assistant, may answer. What you text, and what you say on a call (turned into text as you speak by our phone provider, Twilio), is sent to Anthropic, the company that makes the Claude AI Otis runs on, to write his answers. We keep your phone number, what you said or texted, and what Otis answered as a written record for one year, the same as chats on our Website. We don’t record the audio of calls. If you ask Otis to pass a message to our office, he emails it to our staff with the details you gave him.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the sharing described in section 4 excludes text messaging originator opt-in data and consent; this information will not be shared with any third parties.
To stop our texts, reply STOP to any of them, or turn texted codes off on your portal account’s Account security page. Reply HELP for help.
